LIMITATION OF LIABILITY
#2 Septic is not responsible for the failure of any septic system component, including pumps, floats, alarms, pipes, tanks, septic fields, or electrical components, before, during, or after service. Our service does not guarantee the condition or future performance of your septic system. We are not liable for sewage backups, overflows, property damage, or other losses resulting from pre-existing conditions, equipment failure, misuse, excessive water use, or failure to complete recommended repairs this includes any pump prime loss. By accepting our services, you acknowledge and agree to these terms, except where prohibited by law or where damages result solely from the proven negligence of #2 Septic. LIMITATION OF LIABILITY
By requesting or accepting service from #2 Septic, the customer acknowledges and agrees to the following:
#2 Septic is not responsible or liable for the failure, malfunction, or deterioration of any septic system component, including but not limited to pumps, floats, alarms, control panels, electrical components, pipes, tanks, septic fields, fittings, or any other part of the system.
Our services are limited to the work specifically requested and performed at the time of service. We do not guarantee the condition, operation, or future performance of any septic system or its components.
#2 Septic shall not be liable for any sewage backup, overflow, flooding, property damage, environmental damage, loss of use, personal injury, or consequential damages resulting from:
Existing defects or pre-existing conditions.
Pump prime loss causing pump to airlock
Failure of any septic system component before, during, or after our service.
Clogged, damaged, collapsed, frozen, or improperly installed piping or system components.
Electrical failures, power outages, pump failures, or float failures.
Excessive water use following a system alarm or backup.
Failure to repair or replace defective system components after being advised to do so.
Circumstances beyond our reasonable control, including weather, flooding, or acts of nature.
Any recommendations made by #2 Septic regarding repairs, maintenance, replacement, or further inspection are advisory only. The property owner is solely responsible for maintaining their septic system and for arranging any necessary repairs.
The customer agrees to indemnify and hold harmless #2 Septic, its owners, employees, and contractors from any claims, damages, losses, liabilities, costs, or expenses arising from the condition or failure of the septic system, except where caused solely by the proven negligence of #2 Septic in performing the specific services contracted.
Acceptance of service constitutes acceptance of these terms.
6-MONTH LABOUR WARRANTY
#2 Septic warrants its workmanship for 6 months from the date of service. This warranty covers defects resulting solely from our workmanship. It does not cover parts, pumps, floats, alarms, electrical components, normal wear and tear, misuse, freezing, power outages, blockages, pre-existing conditions, or the failure of any septic system component. Parts supplied or installed by #2 Septic are covered only by the manufacturer's warranty, if applicable. Any warranty claim must be reported promptly upon discovery and before any repairs are performed by others.
